A placement is a paid position in a public list on this website, together with a link to a destination URL you supply. You are buying advertising placement and nothing else. You are not buying an endorsement, a review, a certification, a guarantee of traffic, sales, or search ranking, or any form of equity or ongoing right.

Positions are ordered solely by the amount currently paid for each listing, highest first, with ties resolved in favour of whoever reached that amount earliest. No element of chance, drawing, or random selection is involved at any point. This is a fixed-price advertising placement, not a contest, sweepstakes, lottery, or game of chance, and no prize is offered or awarded.

A placement begins when your payment clears and continues until another buyer pays more for that position, at which point your listing moves down accordingly. There is no minimum, guaranteed, or fixed duration, and no lifetime placement is offered or implied. Your placement may be displaced within minutes of purchase. If that outcome is unacceptable to you, do not purchase a placement.

Payments are processed by Whop. The minimum placement fee is $25. Fees are charged in full at checkout.

All placement fees are final and non-refundable. Being outbid, displaced, or moved down the list is the advertised and intended operation of the service and is not a defect, failure of delivery, or ground for refund or chargeback.

The only exceptions are: (a) we remove or decline your listing under section 5, in which case we refund the fee paid for the removed placement; and (b) a duplicate or erroneous charge, which we will refund on request.

Initiating a chargeback for a placement delivered as described is a breach of these terms. We may permanently decline further listings from a buyer or domain that does so, and will supply the payment processor with the listing record, timestamps, and delivery evidence.

We decline and remove listings involving: sexually explicit or adult content; illegal goods, services, or substances; counterfeit items; malware, exploit tooling, stresser or booter services; phishing, credential theft, or trade in accounts or personal data; offers promising guaranteed financial returns or fixed outcomes; pyramid or matrix schemes; and any content prohibited by our payment processor.

We also remove listings whose destination differs materially from what was submitted, including cloaked links and redirect chains that terminate somewhere other than the submitted domain.

We may decline or remove any listing at our sole discretion. Where we do so for reasons other than your breach, we refund the fee paid for that placement.

You represent that you own or are authorised to promote the destination you submit, that its content is lawful in the jurisdictions where it is offered, and that your listing text is accurate and not misleading. You are responsible for the destination and everything on it.

Prices are exclusive of taxes unless stated otherwise at checkout. Where sales, use, VAT, GST, or digital advertising taxes apply to a placement fee, they are calculated and collected at checkout by our payment processor and remitted to the relevant authority. You are responsible for any taxes arising from your own use of the placement.

The service is provided as-is. We do not guarantee uninterrupted availability, and we may change the ranking mechanic, minimum bid, increment, or category structure. Material changes to the ranking mechanic will be published on the rules page before they take effect. Existing placements are not refunded on account of such changes.

To the maximum extent permitted by law, Daniel Lomonaco is not liable for indirect, incidental, special, or consequential damages, or for lost profits, revenue, traffic, or business opportunity. Our total aggregate liability arising from or relating to a placement is limited to the amount you paid for that placement in the twelve months preceding the claim.

You grant us a non-exclusive, royalty-free licence to display your submitted name, description, icon, and destination URL on this site and in share images and social previews generated from it, for as long as the listing is displayed. You retain all other rights. If you believe a listing infringes your rights, contact us at support@overthrone.lol with details and we will review it.

These terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of law rules.
